These Terms of Service ("Terms") govern your access to and use of the website operated by ProspereAI ("we", "us", "our") at prospere.ai and related pages (the "Site"), and any information, communications, or materials we make available through the Site.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site. These Terms are a general template for a business website and do not replace legal advice for your situation.

The Site presents information about our AI automation, consulting, and related services. Descriptions on the Site are for general information and marketing purposes and do not constitute a binding offer unless we confirm otherwise in a separate written agreement.

Specific projects, pricing, timelines, and deliverables are subject to individual contracts or statements of work between you and us.

You agree not to misuse the Site. Without limitation, you must not: (a) use the Site in violation of applicable law; (b) attempt to gain unauthorized access to our systems, other users, or third-party services; (c) interfere with or disrupt the Site or its infrastructure; (d) scrape, harvest, or collect data from the Site by automated means without our prior written consent; (e) upload malware or harmful code; or (f) use the Site to send spam or unlawful content.

We may suspend or restrict access if we reasonably believe you have breached these rules.

The Site may embed or link to third-party tools, for example Trustpilot widgets for reviews. Those services are provided by their respective providers under their own terms and privacy policies.

We are not responsible for third-party services or content. Your use of them is at your own risk and subject to the third party's rules.

The Site and its content are provided "as is" and "as available" to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement where such disclaimers are allowed.

We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by applicable law, we and our affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities, arising from or related to your use of the Site.

Our total aggregate liability for claims arising from the Site (other than liability that cannot be limited under mandatory law) shall not exceed one hundred (100) EUR or the amount you paid us in the twelve (12) months before the claim, whichever is greater. Unless mandatory consumer law requires otherwise, these Terms are governed by the laws of Poland, and the courts of Warsaw, Poland, have non-exclusive jurisdiction over disputes arising from the Site, subject to any rights you may have as a consumer in your country of residence.
